Business Restructuring
Small and medium-sized enterprises (SMEs) and entrepreneurs in financial distress face a very unique set of immediate challenges. Most business owners are not trained in financial restructuring. This is a time for timely decision-making and a proactive approach to the financial challenges facing the business.
Our approach is to immediately stabilize the situation and to quickly develop effective plans to ensure short-term survival and set the business up for long-term success. Trivista looks out solely for the interests of its clients, not their creditors, to find the most effective solutions for the business and the business owners while helping them to avoid bankruptcy.
Debt restructuring can involve informal restructuring or in more complex cases, formal restructuring under the Bankruptcy and Insolvency Act (BIA).
Informal debt restructuring means negotiating directly with each creditor, supplier, and potentially CRA. The end result can be any or all of a one-time settlement of delinquent debt, modification of secured lending agreements, or a new payment arrangement with CRA.
Formal debt restructuring involves obtaining legal protection from the actions of creditors by using the Bankruptcy and Insolvency Act.
Once the restructuring process is complete, we can assist with incorporating a new company and acting as the registered and records office for the company. Consumer Debt Restructuring
A consumer debtor may be able to complete an informal restructuring by doing direct settlements with a few key creditors or may need to do a formal restructuring by filing a proposal under the BIA with a Licensed Insolvency Trustee. Trivista Law can help clients navigate both these options.
